Trade Mark Registration

Trade Mark Registration in UAE

The Trade Mark Registration in UAE is an important and essential process that safeguards your trade mark, which can be a name, logo, slogan, symbol, or design, from being used by others without permission. This exclusive right to use a trade mark in relation to certain goods and services can be attained by registering a trade mark in UAE.

The UAE trademarks are registered and controlled by the Ministry of Economy (MOE), and this applies to all organizations operating in Dubai, Abu Dhabi, Sharjah, and the rest of the UAE. As a start-up, SME, corporate, or global business, registering your trademark will protect your brand and boost its value.

A registered trademark may be protected through an infringement lawsuit, licensing, franchising, or even sold as an intellectual property right. An unregistered trademark may pose a risk to businesses in terms of counterfeiting, abuse, litigation, or damage to market reputation.

The procedure to register a trademark in the UAE consists of search, making an application, examination, publication, and the issuance of the certificate. The whole procedure has to be carried out meticulously in order to avoid any objections or rejection of the trademark due to similarities or classification issues.

The 365 Day PRO Corporate Services also offers full-scale “Trademark Registration Services in the UAE” assistance in regard to documentation, application submission, follow-ups, and approvals.

Trade Mark Registration Procedure in UAE (Detailed Step by Step Process):

Below is an authoritative process for the UAE Trademark Registration process under the Ministry of Economy & Tourism (MOET).

Step 1: Define the trademark and ownership (what you are registering)

  • Identify the trademark type: word mark, logo, tagline, or combined mark

  • Confirm ownership: individual, UAE company, or foreign company

  • Ensure the owner’s name matches exactly with the trade license or passport

  • Incorrect details may lead to objections, delays, or rejection

Step 2: Choosing the proper class (NICE Classification)

  • Choose the appropriate category of goods and/or services for classification under the Nice Classification (The UAE follows the Nice classification system, which has classes for goods and services).
  • The reason this step is so important is that protection is afforded on a class basis—wrong class = poor protection/objections later on.

Step 3: Trademark availability search (Risk Reduction)

  • The third step is to perform  a similarity/availability check to minimize, Risk of Rejection in the Examination and the risk of opposition during publication
  • Even if it’s not mandatory, it’s a great pre-filing strategy for obtaining approvals at a faster pace.

Step 4: Prepare the application file (bank-ready style documentation)

  • Prepare: Trademark image/logo (clear format)
  • Details of owner/proprietor & List of Goods/Services
  • POA (if applying through an agent/representative)
  • Trade license (if company-owned)
  • The MOET service can be accessed through the MOET Website / Smart App.

Step 5: Submit the trademark application on the MOET portal

Submit the application through the official MOET trademark service and pay the mandatory fees as indicated in the online workflow.

Step 6: Examination of ministry and decision (Accept, Reject, or Conditional)

The MOET will examine the application and make a decision. The information on the MOET service shows the average time to study and make a decision.

If the examiner has raised an objection, then you will need to answer back with clarifications/amendments as required.

Step 7: Publication in the Official Trademark Bulletin (official publication)

If it gets approved, the mark gets published in the “Official Trademark Bulletin” (published bi-monthly).

Step 8: Opposition window (30 days)

The objection/opposition period is 30 days from the date of publication of the bulletin.

If there is opposition, the case has to be managed and concluded prior to the final registration.

Step 9: Pay final registration fee and obtain the certificate

Once the objection period is over (without any successful objections), the final registration fee (AED 5,000) is paid, and the registration certificate will be obtained within 30 days from the completion of the objection period, as per the MOET service details.
